HBOJudge Granted HBO’s Bid To Pause Arbitration. 07-11-'19

A federal judge Thursday granted entertainment network HBO’s bid to pause arbitration proceedings with the estate of Michael Jackson over the 'Leaving Neverland' documentary pending HBO’s appeal to the Ninth Circuit.

The network called the 27-year-old agreement invalid in court papers and moved to dismiss the case under California’s anti-SLAPP statute, which protects against meritless complaints that impede free speech rights.

In a September ruling, U.S. District Judge George Wu denied HBO’s bid to toss the complaint and sent the matter to arbitration.

HBO filed court papers a month later seeking to stay Wu’s order until the Ninth Circuit rules on whether the entertainment network would be “irreparably harmed” by arbitration proceedings.

At issue is whether arbitration in this matter has the effect of chilling HBO’s speech by providing Jackson’s estate with a “perpetual forum” to criticize the documentary, court papers said.

“The public interest favors a stay given the strong interests in protecting the exercise of First Amendment rights and promoting expressive, newsworthy works exploring issues of public concern such as 'Leaving Neverland',” attorneys for HBO said in court papers.

At a hearing Thursday (November 7) in federal court in Los Angeles, Wu granted HBO’s motion for a stay and said he’d like the Ninth Circuit to weigh in on the First Amendment questions.

“This is not a typical arbitration case,” Wu said, adding later the case is unique because of the First Amendment concerns and that he “isn’t here just to enforce a contract.”

Jonathan Steinsapir of Kinsella Weitzman Iser Kump & Aldisert, an attorney for the Michael Jackson estate, told Wu the stay is simply an HBO delay tactic and that multiple courts have rejected the notion that arbitration equals irreparable harm.

“We’re not seeing evidence that anyone has been silenced,” Steinsapir said regarding HBO’s free speech concerns. “Michael Jackson is still the most talked about celebrity in the world.”

“Trump may have superseded him, I think,” Wu said, prompting a chorus of chuckles from the gallery.

Bryan Freedman of Freedman & Taitelman, an attorney for the plaintiffs, told Wu he is making a simple breach of contract case more complicated than it needs to be.

“We think it’s a typical contract case. HBO are big boys and they bargained for a contract,” Freedman told Wu. “The harm to us is not being able to put this case before an arbitrator.”

Michael Jackson's Socks For Sale. 06-11-'19

Michael Jackson's socks are expected to sell for over $1 million at auction when they go under the hammer later this month.

The late 'Thriller' hitmaker - who died in 2009 aged 50 - donned the custom crystal stockings the first time he showed off his famous moonwalk during a performance of 'Billie Jean' in 1983 TV special 'Motown 25: Yesterday, Today, Forever' and they are going under the hammer under the next few weeks.

Auction site Gottahaverockandroll.com are offering the socks as part of their Frank DiLeo collection and they come with a signed letter from Michael to the late music executive - who signed the 'Bad' singer to Epic Records and managed him from 1984 to 1989 - presenting the gift to him as a token of appreciation for keeping the star on his ''toes'' throughout his 'Victory Tour'.

The package - also comes with a certificate of authenticity and a letter from Frank's wife confirming Michael wore them for his moonwalk debut - is expected to fetch a seven-figure sum of up to $2 million.

Fans who don't have the cash to splash on the socks can also look to other lots for a rare piece of Michael memorabilia, as also up for sale will be original gold and platinum awards for 'Thriller', 'Dangerous', 'Bad', 'This Is It' and 'Off The Wall', and a prop sign used in the 1988 film 'Moonwalker'.

Michael's SocksAuction company GottaHaveRockandRoll are offering the socks as part of their Frank DiLeo collection in the coming weeks (pictured in November 2009).

Meanwhile, Michael's oldest son, 22-year-old Prince recently reflected on his dad's legendary music career, and admitted despite finding it difficult to chose a stand-out track, he does have his favourites.

He added: ''One of my favourite songs... is 'Man In The Mirror' because it's such a great call to action, you know, everybody can get behind. It is like, 'If you really want to make a change for the world, you need to change yourself first and you need to really look within and see yourself for who you actually are.' ''

A Fast track of the Best Selling music artists from 1969 to 2019 has been hugely shared on social media by Michael Jackson’s fans.

The reason is that Michael Jackson mostly top the list from 1980 to 1997, nearly 2 decades!

While the visual is really interesting to watch and you can see artists going right up and right down within a year, this is a really interesting video as showing Michael Jackson being the only artists staying so long to the top of the list. I guess this is why he is the King of Pop!

Michael Jackson’s Estate Acquires Sly And The Family Stone’s Catalogue. 02-11-'19

The Estate of Michael Jackson/MIJAC Music has acquired majority ownership of Sly and the Family Stone’s catalogue in the United States. Outside of the U.S., it owns the entirety of the band’s catalogue. In a press release obtained by Pitchfork, Sly Stone said, 'Thank You Mijac (Falettinme Be Mice Elf Agin)', a reference to the 1969 Sly and the Family Stone hit 'Thank You (Falettinme Be Mice Elf Agin)'.

“Sly and the Family Stone were a force for enlightenment and positive change, a message that Michael believed in,” the estate’s co-executors John McClain and John Branca added in the release. “He recognized [Sly Stone]’s genius and the power of his words and music which is why he first acquired the catalog and why we at MIJAC follow in Michael’s footsteps today.”

Sly And The Family StoneSly and the Family Stone was an American band from San Francisco. Active from 1966 to 1983, it was pivotal in the development of funk, soul, rock, and psychedelic music.

Sly and the Family Stone’s royalties have been hotly disputed, even in recent years. Just a year ago, Primary Wave Music Publishing claimed to have interest in the band’s catalogue, but the Jackson Estate disputed those claims. In 2010, Sly Stone sued his longtime manager, Jerry Goldstein, for allegedly defrauding Stone of “tens of millions” in royalties. A jury awarded Stone $5 million in damages in 2015, but later that year a judge ruled that Stone could not collect because he sold his royalties to a production company in the 1980's.

Michael Jackson Alive Conspiracy: Singer Urged To Get DNA Test To Prove He's MJ. 02-11-'19

Sergio CortesMichael Jackson fans have urged the singer to take a DNA test to prove he isn't the real Michael Jackson.

Michael Jackson is alive and pretending to be an impersonator of himself, bizarre fans have claimed.

The King of Pop died in June 2009 of a homicidal overdose.

Since his demise, conspiracists claim the singer faked his death in order to shy away from the limelight.

And a new video has added further fuel to the conspiracy fire.

Bombshell footage has since emerged on Facebook seeing fans demand a DNA to be done on an MJ impersonator.

In the clip, Michael Jackson impersonator Sergio Cortes promotes an upcoming gig in the Thai city of Pattaya on December 23.

But the Spanish musician's MJ likeliness has sent fans asking questions.

The man is seen sporting the same black locks and facial features.

Sergio says, in a high pitched voice very much like Jackson's: “Hello to all Michael Jackson fans, come and watch me perform at Hollywood Pattaya on December 23rd.

“I love you guys and see you there. I am Sergio Cortes, see you soon.”

But since uploading the clip to his 111,000 fans, hundreds have flooded in asking for him to prove he isnt the real deal.

One person said: "Oh my god, you're not Sergio Cortès, you're Michael Jackson.
"Someone get his DNA."

A second added: "I need a DNA test, I'm sorry."

"This is the best impersonation I’ve seen of Michael as far as looks," another stated.

Not all viewers believed the bizarre claims, one person said: "That's not the real Michael, he's an impersonator."

The conspiracy world was also sent into a frenzy back in 2016 when Jackson’s daughter Paris uploaded a selfie to Instagram.

At first glance, it appeared a normal photo from inside her car.

But truthseekers soon claimed to have spotted a shadowy figure in the back seats.

YouTube theorist beLIEve uploaded the image to his channel, before editing it to “lighten” the background – with the face of MJ appearing.

Jackson was found dead at a Los Angeles mansion in 2009, aged 50 years old.

He suffered a heart attack after a propofol overdose administered by his physician Conrad Murray, who later spent two years in jail for involuntary manslaughter.
