Kenny Ortega Demands To Be Removed From MJ Wrongful Death Lawsuit. 31-01-'11

Kenny Ortega is continuing his battle to be dropped as a defendant in Katherine Jackson’s lawsuit against AEG, now Radar Online has published his detailed legal filing.

Ortega was named by Katherine as one of the people she believes is responsible for her son’s death. Nothing could be further from the truth, Ortega says and on January 26, he filed a Memorandum of Points and Authorities stating he was “wrongfully and mistakenly named as a defendant in this case.”

Ortega, the document states “has been extremely hurt by this mistaken and misguided Complaint publicly naming him as a defendant allegedly responsible for his friend’s death.” He’s asking the court to remove him as a defendant in Katherine’s ongoing lawsuit against the giant entertainment and sports presentation company, AEG.

Sneaky Fans Denied Entry Into MJ's Tomb. 30-01-'11

TMZ has learned two conniving Michael Jackson fans tried to scam their way into the King of Pop's resting place this week, but their plan was foiled when security told them to beat it.

According to sources, shortly after Dr. Conrad Murray's hearing on Tuesday, several rabid fans descended upon Forest Lawn to pay their respects to MJ -- but two women in particular took it to the next level.

We're told they rang the bell outside of the mausoleum repeatedly until a security guard answered, who told them they weren't allowed in MJ's tomb.

According to sources, they told security they weren't there for Michael, but for the famous guru Yogananda -- who doesn't have restrictions on who he allows inside. Security didn't buy their tale and promptly told them to leave.

A rep for Forest Lawn tells us, "The two women were not kicked out of the par, but they were not allowed into the mausoleum and asked to leave that part of the park."

Rebbie Jackson About The Murray Trial “It’s Been A Living Nightmare”. 28-01-'11

Michael’s oldest sister Rebbie says she still feels like she is in ‘a living nightmare’ two years after Michael’s death. The 60-year-old singer, who has kept a lower profile than most of her relatives, said the loss of Michael was “devastating”. “It’s been like a living nightmare, to be very honest,” Rebbie, who helped raise her brother, admitted on U.S. TV’s The View.

“A day doesn’t go by where I don’t think about it – think about him. Some times in the middle of the day I just break down and start crying.”

Rebbie dismissed reports of dissent among family members over the distribution of Michael’s estate – and insisted the trial over his death has instead brought them closer. “Everybody is working toward wanting to see justice because of the way he died,” she said. When asked about Conrad Murray, she replied: “I have faith in the judicial system and we are going to find out the truth with everything in these few weeks.”

Asked if when she looks at Conrad she feels like she is looking at her brother’s killer she paused before admitting: “Yes I do. I do. But I want the truth to come out. It’s very difficult – you have to see there and see all that.” She admits that the “family was very much aware” that Michael had problems with drug use and “there were many times there were interventions”.

“But even though that’s the case, still it has to be explained and exposed what happened at the end,” she stressed. She said her mother Katherine “seems to be holding on”, adding: “My mum has a very strong constitution – she knows what she wants to do and she’s doing it just fine.”

Concert Promotor Of Michael Jackson Tribute Concert Sued For Fraud. 28-01-'11

The City of Summerside, P.E.I., is suing an American concert promoter for fraud, saying it paid $1.3 million for a Michael Jackson tribute concert that did not exist. The city filed papers Monday in a San Jose, California, courthouse against Katrina Berg Sussmeier and her promotion company, Starlink Productions. The city claims Sussmeier promised it could host the first concert of an official Michael Jackson tribute, featuring stars such as Beyonce, Justin Timberlake, Rihanna and Usher. Summerside would have kicked off the world tour July 24.

“In reality,” reads the statement of claim, “the Michael Jackson Tribute Show was, from start to finish, an elaborate fraud.” The statement of claim describes how the city fell completely for Sussmeier’s plans.

It says the city wired two separate payments of $650,000 to the promoter: the first in July 2009, the month after Michael died, and the other in March 2010. The second payment was sent to the promoter despite red flags already being raised for the city. The second payment was made despite growing doubts.

“Summerside officials became increasingly concerned about the status of the concert,” says the statement of claim about the months leading up to that final payment.

The city is suing to get back the $1.3 million in taxpayers money, as well as for unspecified damages.

Las Vegas Walk of FameStory Behind MJ Broken Heart Stone. 27-01-'11

A unique piece of Michael Jackson memorabilia is about to be auctioned off in February. It is a 500 lbs. cement slab that's dated June 1984 and it features the hand print, footprints and autograph of the King of Pop.

Jackson was at the top of his career when the stone was created. Originally, it was made for the Walk of Fame project for the city of Las Vegas but that never materialized. So, the stone stayed hidden in the basement of the Riviera Hotel for more than two decades before being sold.

Owner of the stone, Andrew Wilson, explains how he came into possession of it. "I was at the right place, at the right time." The former five time international Kung Fu champion and Santa Maria resident had formed a business relationship with Jackson. He said, "I was very supportive of him during the trial." Wilson even wrote a letter of support for Jackson to a local newspaper. "I got word back from the people at Neverland that Michael had seen it and was very pleased about it," said Wilson.

Wilson says that on the day Jackson died, he arrived in Las Vegas and ran into some of those same people. He said, "People at Neverland knew me and said oh my gosh, I think Michael would love for you to have this." They put him in contact with the then-owner of the impression.

How did the cement slab get it's name? Wilson says, "You can actually look at his hand and you can actually see a heart print." The left palm print features a heart shape design with a crack running through it. That's how the name 'The Broken Heart Stone' came about. "A broken heart represents not only Michael but the fans that loved him," said Wilson. "I think it's kind of a statement to the world. 'Yeah, I died with a broken heart and I have fans who have a broken heart because of me.'"

'The Broken Heart Stone' is being auctioned by a company specializing in Hollywood memorabilia. The auction ends Tuesday, February 15th.

Michael Jackson's Burnt Hair Goes Up For Sale. 27-01-'11

It's been 27 years since the fateful day when Michael Jackson was burned while filming a Pepsi commercial. On January 27, 1984, Michael and other members of the Jacksons were filming a commercial for Pepsi at the Shrine Auditorium in Los Angeles when, during a concert scene, explosive pyrotechnics accidentally set Jackson's hair on fire (video is after the jump). Jackson suffered serious burns to his scalp and he never fully recovered from this injury. It is said to have led to his addiction to painkillers. Jackson received a $1.5 million settlement which he donated to the Brotman Medical Center which had treated him after his injury.

A Small Piece of History is selling hair from this sad moment. Executive producer for the Pepsi commercial, Ralph Cohen, was among the first to reach Jackson when his head was burning and he threw his jacket over Jackson's head to help extinguish the flames. The lots feature hair that measures just 1/16 of an inch and is on a display card. There are limited, multiple lots available and purchasers can request lengths to suit. Lots sell for £149.99.

Michael Jackson: Secret Business Genius? 26-01-'11

In 2010 Michael Jackson earned $275 million — more than Beyoncé, Lady Gaga, Madonna and Jay-Z combined — despite the fact that he was no longer alive.

Though much of that total can be attributed to the swell of nostalgia that boosted sales of all things Michael in the months following the King of Pop’s death, a sizable part is the product of his underrated business acumen.

Katherine Jackson Can't Stand To Look At Conrad Murray's Face In Court. 26-01-'11

Michael Jackson's mother Katherine "can't stand" to look at Dr. Conrad Murray's face as he battles charges of involuntary manslaughter, admitting she's having a "difficult time" coping with the court cases stemming from her son's 2009 death.

The Jackson family matriarch appeared on U.S. breakfast program "Good Morning America" on Tuesday, January 25 and revealed her struggle to sit through court proceedings in the run-up to Murray's trial. The medic stands accused of administering the drug Propofol which killed the singer in June 2009.

Murray pleaded not guilty to the charge on Tuesday, January 25 ahead of his trial on March 28 - and Katherine Jackson insisted the aftermath of the singer's death has proved to be a very tough journey. Jackson said, "It's been a difficult time for me ever since my son passed. When I'm in that courtroom I can't stand to look at that man (Murray)... and I go because I love my son... I just feel I have to be there."

In addition to Murray's involuntary manslaughter case, Katherine is dealing with a copyright infringement lawsuit filed by the singer's estate executors against her business partner, Howard Mann. Her associate is accused of publishing a number of unauthorized photographs in new coffee table book, "Never Can Say Goodbye", and the 80 year old is taking the litigation particularly personally: "As far as the estate suing Howard Mann, my feeling is when they're suing Howard Mann they're suing me... because I authorized the book."

As the court cases unfold, Jackson is also caring for her late son's three children, Prince Michael, 13, Paris, 12, and eight-year-old Blanket. But she insists she's not having trouble raising the kids despite her advancing years: "Michael's children are good children, and he raised them out of love and understanding. I don't have a hard time with them, because they know what, how their father had them raised, and their very respectful and also it's a difference today."

However, Katherine has one stern rule - she will not be allowing her grandchildren to follow in their father's famous footsteps until they are older. She adds, "I wouldn't let (them) go into business at this early of age, like Paris wants to be an actress... and I don't think Michael would have let her. He talked about (how) he didn't have a childhood, he wanted to be more... play more."

Michael Jackson ‘Mortified By Elizabeth Taylor Necklace Mix-up’. 25-01-'11

Michael Jackson was left mortified when Dame Elizabeth Taylor mistakenly thought he had gifted her an expensive necklace, according to a new book.

The pop icon and iconic actress were close friends up until Michael’s death on June 25 2009. Elizabeth, 78, was so devastated by his death she felt unable to attend his memorial, and also didn’t release a statement for several days.

Michael’s good friend and associate Frank Cascio has penned a book about the pop superstar, titled My Friend Michael: Growing Up With the King of Pop. He relives many of the fun times he had with the star in it, and also gives some insight into Michael’s relationships with his friends.

Frank claims Michael managed to convince Elizabeth to be a part of a special marking his 20th anniversary in the music business by presenting her with a pricey diamond necklace.

“According to Frank Cascio, Taylor thought the borrowed bauble was a gift and was horrified when the jeweller asked for it back. Jackon had to apologise to her for the mix-up,” reports the New York Post.

The special event consisted of two concerts held in 2001, which were later televised.

Frank’s tome is slated for release later this year, with some of the proceeds being donated to children’s charities.

Michael Jackson Closest Friend Signs Book Deal. 25-01-'11

Cascio, who sometimes has been known as Frank Tyson, is the eldest son of the Cascio family of New Jersey, Jackson’s surrogate family.

It was Cascio to whom Michael turned in 2003 when he needed someone to oversee the Arvizo family. It was Cascio’s record keeping that helped exonerate Jackson on the counts of conspiracy in 2005.

Frank Cascio’s brother, Eddie, is the author and producer of several tracks on Michael’s new album, called “Michael.”

But it was Frank who originally worked on that music with another singer.

Now Frank Cascio will explain his and his family’s long relationship with Michael and with his kids.

Frank is also setting up a charitable venture into which he will contribute proceeds from the book. I hear that the charity will build schools and help children in Haiti. Details are forthcoming. And many big name celebs are said to be signing on. (I can’t say the names, but they’re the real deal.)

If anyone in the Jackson saga was to write a memoir — besides manager Frank DiLeo–it would have to be Frank Cascio. His 25 year relationship with the pop star was a constant, whether Jackson was experiencing highs or lows.

Murray Returns To Court . 25-01-'11

Dr. Conrad Murray faces arraignment Tuesday morning on involuntary manslaughter charges in the death of Michael Jackson.

The hearing is expected to last just a few minutes with Los Angeles County Superior Court Judge Michael Pastor. Murray is expected to plead not guilty. He has the right to demand a trial within 60 days however, a trial date is not expected to be set yet.

Judge Pastor ruled after a preliminary hearing earlier this month that there was enough evidence to send Murray's case to trial.

"Michael is not with us today because of an utterly inept, incompetent, reckless doctor, the defendant Conrad Murray," Los Angeles County Deputy District Attorney David Walgren said in his closing arguments at the time.

Murray remains free on a $75,000 bond, but the judge blocked the doctor from using his California medical license until the trial is completed. The state medical board requested that be made a provision of his bail.

Murray's lawyers appeared satisfied with the results of the preliminary hearing because of testimony they got from prosecution witnesses that could aid in their strategy of claiming Jackson killed himself.

"I think the prosecution is going to change their tactics in this case," defense attorney J. Michael Flanagan said after court. "It's not the same as what they gave in opening statements."

The prosecution's expert witness in the case admitted he made a math error and that the recalculation supports the defense theory that Jackson may have given himself the fatal dose of propofol.

Dr. Richard Ruffalo, an anesthesiologist hired by the prosecution, was the last witness to take the stand.

"I actually made a mistake on that," Ruffalo said during cross-examination, referring to his calculation of the levels of propofol found in Jackson's stomach fluid. "Now it doesn't make sense unless he ingested it orally in a huge amount," Ruffalo testified.

Murray's lawyers had previously suggest a frustrated and sleepless Jackson may have poured the surgical anesthetic into his juice bottle while the doctor was out of his bedroom.

The admission drew an audible gasp from Jackson's family members present in the courtroom.

However, Ruffalo still placed the blame squarely at Murray's feet, saying that the doctor left dangerous drugs near a patient who was clearly addicted.

"It's like leaving a syringe next to a heroin addict," Ruffalo said. "If he's not getting what he wants, when you leave the room he might reach for it himself."

"Either way, it doesn't matter," he testified. "He abandoned his patient and didn't resuscitate appropriately."

The pathologist who conducted Jackson's autopsy acknowledged it was possible, although highly improbable, that Jackson gave himself the fatal dose of the propofol.

Spike Lee MJ Movie Put On Hold. 25-01-'11

Director Spike Lee has been rumored to be hard at work on a new film that would pay tribute to the King of Pop but now it looks like that movie may not happen.

The movie, which was to be titled "Brooklyn Loves Michael Jackson," would examine the potential impact a tribute concert in Jackson's memory would have on a regentrified community of Brooklyn, New York. Several big names were attached to the project at one time, including Samuel L. Jackson, Julianne Moore, Rosie Perez, Anthony Mackie and John Turturro.

However, the project appears to have been scrapped. When a fan recently asked Lee how the film was shaping up, Lee responded that it wasn't and quickly moved on to other questions.

The film was something of a special project for Lee, a huge Michael Jackson fan who directed both versions of Jackson's videos for "They Don't Care About Us," as well as an unofficial video for the song "This Is It." Lee has also thrown huge block party events to celebrate Jackson’s birthday’s for the past two years.

There is no word on whether or not the movie will ever be re-visited.

Michael Jackson Theme Park Planned For Gary, Indiana. 23-01-'11

A Michael Jackson theme park has been planned for the late Pop star's hometown of Gary, Indiana. The developers announced that the theme park will be part of a larger $1 billion project that will also include a museum, golf course, 300-room hotel, and a performing arts center. Spokesperson Odie Anderson shared that they hope to break ground later this year.

The theme park and surrounding attractions will be built out in phases over the next decade beginning with the museum. Eventually, the park will include rides from Jackson's Neverland Ranch and a roller coaster themed after his mega hit "Thriller". I would have thought that a Micheal Jackson theme park would have sprung up out of the remnants of the Neverland Ranch in California. But, a park in Indiana has the advantage of being closer to more of the country's population which will give more visitors a shorter trip to the park.

Katherine Jackson: AEG Was Reckless With MJ's Life. 23-01-'11

Katherine Jackson has just filed legal docs claiming AEG was well aware ... there were life-threatening activities going down at Michael Jackson's house ... yet the company turned a blind eye.

Katherine is challenging AEG's motion to dismiss the wrongful death lawsuit against the company.

In her docs, Katherine says AEG retained Dr. Conrad Murray for an "exorbitant salary of $150,000 monthly," and in return Murray agreed to "get Jackson to attend rehearsals and perform."

Katherine's lawyers claim it should have been obvious to AEG when Murray requested CPR equipment at MJ's home that "the medical treatments being administered risked stopping Jackson's heart and breathing."

Katherine's lawyer continues, "This is hardly the type of risk expected in an ordinary house visit from a family doctor."

The lawyers claim, "AEG should have known that the course of treatment being administered by Dr. Murray was unorthodox and unsafe."

Michael Jackson's Mother Challenges Promoters' Lawsuit Dismissal Request. 22-01-'11

Michael Jackson's mother has launched a legal battle with the King of Pop's concert promoters, insisting they ignored life-threatening activities that were going on behind closed doors at the star's rented mansion - and resulted in his death.

Katherine Jackson is suing executives at AEG, the company behind the "Thriller" hitmaker's doomed comeback shows in London, for fraud and negligence. The late pop superstar's physician, Dr. Conrad Murray, has been ordered to stand trial on involuntary manslaughter charges, relating to the June 2009 tragedy - and the singer's mum feels sure promoters knew what he was doing.

Katherine is challenging AEG's motion to dismiss the wrongful death lawsuit against the company, according to TMZ.com. In her documents, she alleges AEG retained Dr. Murray for an "exorbitant salary of $150,000 monthly," and in return Murray agreed to "get Jackson to attend rehearsals and perform".

Her legal team claims, "AEG should have known that the course of treatment being administered by Dr. Murray was unorthodox and unsafe." Dr. Murray is accused of administering the dose of anaesthetic Propofol, which killed Jackson.

Michael Jackson's Estate Sues Over Website. 21-01-'11

Michael Jackson's estate is seeking the shutdown of a website that is selling a book written by the singer's mother and has released music attributed to the late pop superstar.

The singer's estate sued businessman Howard Mann, who operates the website http://www.jacksonsecretvault.com, on Thursday, claiming both are infringing on copyrights and pose unfair competition.

The website features a book of Katherine Jackson's recollections of her son and released a remix of a Jackson song shortly before the release of a posthumous album last year.

The copyright infringement lawsuit asks a federal judge to turn over the website to the estate. It also seeks all profits from the website, which would go to the multimillion estate that supports Katherine Jackson and the singer's three children.

An e-mail message sent to the site's operators was not immediately returned.

The complaint alleges Mann and the site are using Jackson's likeness improperly, including images from the film "This Is It" and five sketches the singer drew. The lawsuit states Mann has created a false endorsement by including a "special thanks" to the estate in Katherine Jackson's book despite not receiving permission for the use of copyrighted works.

Several of the Jackson Secret Vault releases have occurred at the same time as estate projects were being released, including the anniversary of Jackson's death and the release of the album "Michael" in December. That album sold more than three million copies.

"The Estate had hoped Mann would voluntarily cease his conduct but that was not to be," estate attorney Howard Weitzman wrote in a statement. "People who trade off of Michael's personality, copyrights, and trademarks should not be allowed to exploit the legacy of one of the world's most recognized talents for their own benefit."

Jackson's estate, overseen by attorney John Branca and music executive John McClain, has earned millions and some experts estimate it will eventually rival the lucrative estate of Elvis Presley.

Several lawsuits over Jackson's likeness and copyright have been filed by the estate and merchandiser Bravado.

Parfume Created From Neverland Ranch Flowers To Be Launched In March 19. 20-01-'11

Michael’s father, Joe Jackson made a deal with a French Perfume company to create and launch a new perfume collection dedicated to his son. The scent is created from plants on the Neverland ranch after a chance meeting between perfumier Franck Rouas and some members of the Jackson family at a trade show in Las Vegas.
“Two over-excited kids suddenly burst forward and asked me if they could borrow a pen to get an autograph from someone,” said Rouas. “I asked them whose autograph they wanted – and they shouted: “Michael Jackson’s family”. I gave them the pen, along with two bottles of perfume and asked them if they could give them to Janet Jackson.” An hour later, two bodyguards escorted Rouas to meet the family – after Joe Jackson, smelt the gift.

A deal was signed and Joe chose the basic scents, to be launched in March, using flowers from the Neverland ranch in California. The name of the product line is not announced yet.

MJ Fans 'Disgusted' By Dr. Murray Supporter. 19-01-'11

Propofol Producer Teva Stopped Production And Is Laying Off 270 Employees. 19-01-'11

One thing is for sure; Michael’s death in 2009 will result in changes in the medical world. In September lobbyists are pushing for a new propofol restriction law. They are using what happened to Michael to get support for their cause and “to prevent doctors from making careless choices, and stop them from administrating drugs that should not be administered outside of the hospital setting.”

Today we have learned that Murray’s actions now have extended to the drug Propofol and its Irvine-based maker, which announced it is laying off 200 employees this year after having already let go 70 workers. Teva Pharmaceuticals maintains it already discontinued the hypnotic drug–not because of Michael’s death, but because Propofol was hard to manufacture, the company got little or no profit from it and there were pending lawsuits tied to it.

Risks from the non medical use of Propofol were greatly exposed when the Los Angeles County coroner concluded in August 2009 that Michael died from a mixture of Propofol and the benzodiazepine drug Lorazepam. Bottles of Propofol were found in Michael’s home.

Propofol and Teva, which is headquartered in Israel, have had a rocky relationship. The company previously halted production and recalled some Propofol in 2009 after 41 patients fell ill with flu-like symptoms. That fuelled several of the lawsuits.

Teva announced it will kill 195 of its Irvine jobs by Feb. 6, according to an Orange County Register report.

Chris Mosdell On ‘Behind The Mask’. 19-01-'11

Chris Mosdell wrote the lyrics of ‘Behind The Mask,’ which was recorded by Michael for his ‘Thriller’ album.

“When Michael Jackson took it he made it into a love song, kind of, about a woman,” Mosdell says. “It was a completely different premise to me, but hey, it’s Michael Jackson. I let him have that one.”

The evolution of the song, from its oft-disputed roots to immortality granted by Michael, is a mysterious saga, Mosdell says. One whose climax is Michael recording the song for his ‘Thriller’ album, and the falling action is, the song being omitted at the last minute for copyright issues; and the surprising denouement is, Mosdell hearing from an acquaintance on the street, that the song had finally surfaced on Michael’s posthumous album.

The album, titled ‘MICHAEL,’ released on December 14th is a top-seller around the world, which hit number three in the United States. It contains a collection of unfinished songs, including the original 1982 recording of ‘Behind the Mask.’

The song is now, “back with a vengeance,” Mosdell says.

Facebook Post Not Jason Malachi's. 17-01-'11

A recent Facebook post by someone claiming to be Michael Jackson "sound-a-like" Jason Malachi, stated that it was time to fess up about singing some of the songs on the new MICHAEL album.

The post said, "Sheesh guys, I guess it's time to confess. I've lied to many people, including someone today, but.... It was me. It was me who sang Breaking News, Keep Your Head Up, Monster and Stay.

"I had a agreement with the record company, but now the cat is out of the bag. Sorry to all my fans, and fellow Michael Jackson fans."

However, Jason Malachi's manager was quick to go on the record saying not only did Malachi not post the statement but, he is also the victim of internet fraud.

Speaking to TMZ, Thad Nauden, Malachi's manager, said someone created a phony Facebook page in Malachi's name, claiming that he conspired to fool Sony, the Michael Jackson Estate and the public by secretly singing songs on the album, "Michael."

Nauden says Malachi, who works as a Deputy Sheriff in Maryland, wants everyone to know beyond a shadow of a doubt that he did not sing a single note on the MICHAEL album.

Nauden also said whoever created the Facebook page is malicious and will be prosecuted when found.
